Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Thrive - Smarter Screen Time app, the Thrive - Just a Phone app, our website, and related services (together, the "Service"). By using the Service, you agree to these Terms.

1. WHO WE ARE

The Service is provided by Thrive Digital Wellbeing Pty Ltd ("Thrive", "we", "us", "our").

2. WHO THRIVE IS FOR

Thrive products are designed for parents and legal guardians.

The Thrive apps have different purposes:

  • Thrive - Smarter Screen Time is designed to help parents and guardians manage family screen time using activities, rewards, approvals, and related controls.
  • Thrive - Just a Phone is designed to help parents and guardians configure a simpler, more restricted child device using Apple Family Controls, Screen Time, and related settings.

You must:

  • be at least 18 years old; and
  • have legal authority to manage the child(ren) and devices you connect to the Service.

Children may use child-facing parts of the Service only under a parent or guardian's supervision and control.

3. IMPORTANT: APP-SPECIFIC FUNCTIONALITY AND PLATFORM LIMITS

Thrive products support families in different ways, but neither app bypasses platform controls or grants unlimited access to devices.

  • Thrive - Smarter Screen Time is designed to help parents set activities, rewards, and earned-time rules. It does not create unlimited screen time and does not bypass device or platform controls.
  • Thrive - Just a Phone is designed to help parents apply a simplified configuration to a child's iPhone by restricting apps, websites, and related settings. It does not jailbreak devices and does not bypass Apple platform controls.

The Service is designed to work alongside platform tools, including Apple Screen Time, Family Sharing, Family Controls, App Store purchases, and other Apple-managed services. Those tools and their availability are controlled by Apple and device settings. Thrive is not responsible for platform outages, changes, eligibility requirements, or limitations outside our control.

4. ACCOUNTS, SETUP, AND YOUR RESPONSIBILITIES

You are responsible for:

  • maintaining the confidentiality of your device and account access;
  • ensuring you have authority to connect and manage devices and child profiles;
  • ensuring required settings are enabled on the relevant devices;
  • ensuring the relevant Apple IDs, family setup, purchase settings, and device permissions are properly configured where required; and
  • supervising your child's device use and wellbeing.

You agree not to use the Service in any way that violates law, infringes rights, or harms others.

5. PURCHASES, SUBSCRIPTIONS, BILLING, AND TRIALS

a) Billing platform Subscriptions, trials, and one-time or lifetime purchases may be processed by Apple via In-App Purchase unless we clearly state otherwise. We do not receive your full payment card details.

b) Auto-renewal If you start a subscription, it may auto-renew unless you cancel through your Apple ID subscription settings before renewal.

c) Trials and pricing Trial availability, prices, taxes, and purchase options are shown in the App Store at the time of purchase. Apple may require your confirmation for certain price changes.

d) Cancellations and refunds You can cancel through your Apple ID subscription settings. Refunds, reversals, revocations, and purchase disputes are governed by Apple's policies and applicable law.

e) Paid access and entitlement changes If a subscription ends, a purchase is refunded or revoked, or platform purchase verification fails, some paid or restricted features may stop working, be limited, or revert to a free or reduced state.

6. LICENSE AND PERMITTED USE

Subject to these Terms, Thrive grants you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for personal household use.

You may not:

  • reverse engineer, decompile, or attempt to extract source code, except to the extent permitted by law;
  • bypass, interfere with, or circumvent usage limits, security, or platform controls;
  • use the Service for unlawful, abusive, exploitative, or harmful purposes;
  • copy, sell, rent, sublicense, or commercially exploit the Service.

7. ACTIVITIES, RESTRICTIONS, AND PARENTAL OVERSIGHT

You are responsible for deciding what settings, activities, restrictions, rewards, approvals, and device rules are appropriate for your family.

For example:

  • In Thrive - Smarter Screen Time, you decide which activities count, what rewards are appropriate, and when rewards are granted.
  • In Thrive - Just a Phone, you decide which apps, websites, and settings are allowed or restricted, and how parent approval or PIN controls are managed.

Thrive is not a substitute for parenting, supervision, or professional advice. You remain responsible for your family's decisions and outcomes.

8. AI HELP AND SUGGESTIONS

Some parts of the Service may include AI-powered help, suggestions, summaries, or insights ("AI Features").

  • AI Features can be wrong, incomplete, or inappropriate for your family.
  • AI Features are provided for informational support only and are not professional advice.
  • You must use your judgment and supervise any decisions involving your child.
  • Do not rely on AI Features for safety-critical, medical, legal, or emergency decisions.

Not all Thrive products include the same AI Features. Thrive - Just a Phone may have fewer or no AI Features, and AI is not required for its core functionality.

9. USER CONTENT AND INPUTS

You may input activity names, preferences, labels, website rules, support requests, and other content ("User Content"). You are responsible for your User Content and for ensuring it does not violate law or others' rights.

Do not submit:

  • sensitive personal information you do not want processed, unless the feature explicitly requires it; or
  • any unlawful, abusive, or harmful content.

10. ACCEPTABLE USE

You agree not to:

  • interfere with the Service's operation, including by introducing malware or abusive traffic;
  • attempt unauthorised access to accounts, systems, or data; or
  • use the Service to harass, exploit, or harm any person, including any child.

11. THIRD-PARTY SERVICES

The Service may integrate with third-party platforms and providers, including Apple and other processors or infrastructure providers. Third-party services are governed by their own terms and policies. Thrive is not responsible for third-party services, including their availability, performance, or policy decisions.

12. INTELLECTUAL PROPERTY

The Service, including software, design, text, graphics, trademarks, and logos, is owned by Thrive and its licensors. You may not use our intellectual property except as permitted by these Terms.

13. FEEDBACK

If you provide feedback or suggestions, you grant Thrive a worldwide, royalty-free right to use them without restriction or compensation.

14. DISCLAIMERS

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, secure against every threat, or compatible with every device or configuration.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or other applicable law that cannot be excluded.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Thrive is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.
  • Where liability cannot be excluded, Thrive's liability is limited to the minimum amount permitted by law and, where applicable, the amount you paid for the Service in the 12 months before the event giving rise to the claim.

16. INDEMNITY

You agree to indemnify and hold harmless Thrive from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of law or third-party rights.

17. TERMINATION

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service, users, or third parties.

18. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Victoria, Australia, excluding conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of Victoria, Australia, unless applicable consumer law provides otherwise.

19. CHANGES TO THESE TERMS

We may update these Terms from time to time. If changes are material, we will provide notice within the Service or by other reasonable means. Continued use after changes means you accept the updated Terms.

21. APP STORE TERMS (APPLE)

If you downloaded an app from Apple's App Store:

  • Apple is not responsible for the Service or its content.
  • Apple may be a third-party beneficiary of these Terms to the extent required to enforce them against you.
  • Your use is also subject to Apple's applicable terms and policies.
